The new construction and expansion of PV power generation projects shall not occupy permanent basic farmland, basic grassland (before the latest optimization and adjustment results of the province's basic grassland are announced, according to the current management scope of the identification), Class I protection of forest land.

Notice on Further Regulating the Land Use Management of Photovoltaic Power Generation Projects
Ganzifa [2024] No. 200
The authorities in charge of natural resources, forestry and grassland, and energy in each city, state, and Lanzhou New Area:
In order to support the development of photovoltaic power generation industry, standardize the project land management, according to the "Office of the Ministry of Natural Resources, National Forestry and Grassland Bureau Office of the National Energy Administration Comprehensive Department of the Ministry of Natural Resources on the support of photovoltaic power generation industry to regulate the management of the land of the relevant work of the notice" (Natural Resources Office of the [2023] No. 12), and other relevant requirements, combined with the actual situation in the province, the photovoltaic power generation project land management of the matters are notified as follows:
First, play a leading role in planning. Each region should strengthen communication, the photovoltaic power generation industry development planning, green energy development planning and other special planning and land spatial planning to fully converge in a timely manner, photovoltaic power generation key projects into the city, county, townships, land spatial master plan list of key construction projects. Strictly implement the "three areas and three lines" control requirements of land space planning, optimize the spatial layout of large-scale photovoltaic bases and photovoltaic power generation projects, and reasonably arrange the scale of new land for photovoltaic power generation projects, the layout and development time sequence. Newly-built and expanded PV power generation projects shall not occupy permanent basic farmland, basic grassland (before the latest optimization and adjustment results of the province's basic grassland are announced, it will be determined in accordance with the current management scope), and Class I protected forest land.
Second, adhere to the saving and intensive land use. Photovoltaic power generation projects shall strictly implement the land use standards stipulated in the Land Use Control Indicators for Photovoltaic Power Generation Station Projects (TD/T 1075-2023), and determine the land use scale comprehensively in accordance with the full-area efficiency of the photovoltaic modules, latitude of the installation site, the category of the topographical area, the installation arrangement of photovoltaic arrays and the technological requirements of different boosting grades, and in the context of meeting the conditions of safe operation, implementation and management, and in the context of the utilization of photovoltaic energy, land use intensity, economic efficiency and ecological protection. Under the conditions of safe operation, implementation and management, and in combination with the utilization of light energy, land use intensification, economic benefits and ecological protection, the scale of land use shall be comprehensively determined to promote land saving and intensification.
(c) Standardize compound utilization criteria. PV square land encourages the use of unutilized land, and shall not occupy arable land. Where other agricultural land is occupied, it shall be reasonably controlled in accordance with the actual situation, so as to avoid as far as possible any impact on ecology and agricultural production. Occupying agricultural land other than arable land for the construction of photovoltaic power generation projects, the laying coverage of photovoltaic panels shall meet the light demand and space requirement for vegetation growth under the photovoltaic panels, and encourage the arrangement of space between photovoltaic panels and between photovoltaic columns to guarantee that agricultural machinery can enter the field for operation. On the premise of not affecting the production and function of the facility agricultural land, explore the facility agricultural land has been built on the construction (structure) buildings on the deployment of photovoltaic arrays. Encourage land use units to explore and research advanced technologies and techniques, promote the application of land-saving technologies and land-saving modes, and adopt composite utilization modes according to local conditions.
If the land of PV array involves the use of forest land, it shall adopt the mode of forest-light complementarity, and can use the shrubland in the area with annual precipitation below 400mm and the shrubland in other areas with the coverage lower than 50%, and shall not harvest the forest, cut the irrigation and destroy the original vegetation, and shall not harvest and transform the arbor land, bamboo land, etc., into the shrubland after setting up PV panels; the lower edge of the PV panels shall be higher than the height of shrubs by more than 1 meter. The net distance between each row of photovoltaic panels in the north-south direction should be more than 8 meters, and effective soil and water conservation measures should be taken to ensure that the shrub cover and other growth conditions are not lower than the level before forest-light complementation.
Photovoltaic array land involved in the use of grassland, priority consideration of grassland ecological protection requirements, give full consideration to sand degradation and salinization of grassland vegetation growth of light and heat conditions, and reasonably set the minimum height of photovoltaic panels along the lower edge of the frame. In principle, the annual precipitation is less than 250 millimeters of the region, photovoltaic panels under the edge of the height from the ground is not less than 1 meter; annual precipitation of 250-400 millimeters of the region, photovoltaic panels under the edge of the height from the ground is not less than 2 meters.
(d) Strengthen joint supervision and management. Each region shall establish a joint supervision mechanism to strengthen the guidance and full-life-cycle supervision of the construction of PV power generation projects, and ensure that the project land is used in accordance with the law and regulations, and that it is economically and intensively utilized. To establish a coordinated joint mechanism for project land use, forestry and grass review, for the national large-scale PV base project that meets the requirements of land spatial planning and use control, and is included in the "one map" of land spatial planning, the project land use, forestry and grass will be proposed and required when the project is established and demonstrated. To strengthen the photovoltaic power generation project land, especially the photovoltaic square array land daily supervision, shall not change the land use, unauthorized construction of non-generation of necessary supporting facilities is strictly prohibited. Further strengthen the management of construction sites, incorporate PV power generation project sites into daily inspection and law enforcement, and promptly discover and seriously investigate and deal with illegal and irregular land occupation behaviors.
V. Properly dispose of legacy issues. Prior to the implementation of the Notice on Supporting the Development of the Photovoltaic Power Generation Industry and Regulating Land Use Management (Natural Resources Office [2023] No. 12), the photovoltaic power generation project that has been approved for project establishment, occupies arable land and has not yet begun construction according to the Opinions on Supporting PV Poverty Alleviation and Regulating Land Use for the Photovoltaic Power Generation Industry (Territorial Resource Regulation [2017] No. 8) should have a lower edge of the photovoltaic panels higher than the soil of planting of more than 2 meters. or more; the distance between rows of PV panels (the distance between the centers of the front and back rows of PV modules' piles) should be greater than 6.5 meters. Each region should strengthen the daily supervision and urge the projects that have not yet started (stopped) to be built strictly according to the construction standards.
