Chapter I. General provisions

Combined with the characteristics of the energy industry and the management needs of related special projects, these rules are formulated. Article 2 The key energy special projects are aimed at implementing the new energy security strategy of "four revolutions and one cooperation" and the innovation-driven development strategy, focusing on funding strategic, fundamental and forward-looking major scientific issues, common key technologies and product research and development that have a bearing on the core competitiveness of the industry, the overall capability of independent innovation and national security, and supporting the acceleration of the realization of high-level scientific and technological self-reliance and self-improvement in China's energy sector. It aims to support the accelerated realization of high-level scientific and technological self-reliance and self-improvement in China's energy sector, actively cultivate and develop new productive forces in the energy industry, promote the construction of a new type of energy system, and accelerate the construction of a strong energy country.

Article 3 The organization and implementation of key energy projects shall be guided by the following principles:

(a) Demand-led, strong support. Closely focusing on the major needs of the construction of a new national energy system, with the realization of scientific and technological self-reliance, leading the energy revolution as the core, follow the special implementation plan, optimize the allocation of scientific and technological resources in the field of energy, and continue to practice a new type of national system, focus on solving the scientific and technological bottlenecks and outstanding problems facing the current and future development, and play a global, comprehensive role in driving the industrial chain supply chain security and stability, to provide strong support.

(b) Collaborative research and strengthened application. Nationwide selection of advantageous scientific research teams, give full play to the backbone of the national strategic scientific and technological forces, to carry out collaborative research, strengthen the whole process of target management; strengthen the enterprise-led deep integration of industry, academia and research, the comprehensive use of the first (sets) of major technical equipment in the field of energy-related mechanisms, highlighting the demonstration and application of the target traction, comprehensive measures to support the transformation and application of major technical equipment, and drive the upgrading of the industry.

(c) Prioritizing efficiency and selecting the best. Follow the laws of scientific research, implement a new type of project organization and implementation mechanism, adopt various forms such as "young scientists", "reveal the list of commanders" and "race for the first" to create a benign competition situation between multiple innovation subjects. (d) Strengthening supervision and multi-dimensional evaluation. We will establish a whole-process embedded supervision and evaluation system and a dynamic adjustment mechanism, strengthen information disclosure, focus on "milestone"-style target assessment of key nodes, compact the responsibilities of each innovation body with an operation and management system that is consistent with the rights and responsibilities, standardize the use of scientific research funds, strengthen third-party assessment and evaluation, focus on actual results, and strive to improve the performance of scientific and technological innovation.

Article IV key energy special adhering to the principle of diversified financing, the source of funds are divided into the central financial funds, local financial funds, enterprises and other units of self-financing and other channels of funding, and encourage the implementation of scientific and technological financial innovation initiatives. Each contributor should be in accordance with the implementation program, annual guidelines, mission statement and other requirements, the full amount of funds allocated in a timely manner.

Article 5 The key special is the carrier of the national key R & D program organization and implementation, focusing on the national major strategic tasks, adhere to the goal-oriented, from basic research, technological innovation to the results of the transformation, application demonstration of the whole chain of innovation design, integrated organization and implementation. The National Energy Board can focus on energy-related tasks in the field of research and put forward key special motions, the Ministry of Science and Technology in accordance with the requirements of the project management procedures for the organization and comprehensive balance, the formation of the proposed project proposal (including special name, the main unit responsible for the overall goal, implementation cycle, etc.), according to the procedures for approval. For the urgent needs of the selection of the motion, the National Energy Board in accordance with the requirements of rapid response, flexible deployment, timely submission of project proposals, the Ministry of Science and Technology to take a "case by case" approach to speed up the start.

Article 6 For the approval of the National Energy Board's main responsibility for key special projects, the National Energy Board to take the lead in the preparation of the relevant key special implementation program (including budget estimates, professional organizations), reported to the Ministry of Science and Technology, the Ministry of Finance.

The implementation plan focuses on national needs, focuses on the major scientific problems to be solved or common key technologies to be broken through by the key special projects, sorts out and forms a list of problems and a list of objectives, rationally deploys the main tasks of the research and development phase of the basic research, the major common key technologies and the transformation of the results, etc., and clearly defines the schedule of the deployment of the tasks, the expected major landmark achievements and the requirements for assessment, as well as the details of the resource allocation, the supporting guarantees, and the division of responsibilities, supervision and inspection, transformation of results and popularization and application.

Article 7 The project is the basic unit for the organization and implementation of key special projects, which should be relatively independent and complete, with clear objectives and moderate volume, and the indicators can be assessed and evaluated, and the projects are organically linked to each other, and should serve the objectives of the key special projects, and a certain number of topics can be set up according to the needs, and the topics will no longer be decomposed downwards.

The project fully implements performance management, strengthens performance evaluation and reinforces the application of results, improves the effectiveness of the use of financial funds and ensures the successful completion of tasks.

Article 8: The entire process of key energy special projects shall be incorporated into the management of the unified national science and technology management information system, including the issuance of guidelines, assessment and establishment of projects, use of funds, process management, supervision and inspection, comprehensive performance evaluation and submission of results. It implements the national science and technology reporting system and scientific data submission system, and organizes, preserves and archives the relevant information. Confidential or sensitive information shall be implemented in accordance with relevant confidentiality management regulations.

Chapter II. Organizational and management systems

Article IX The National Energy Board is responsible for the organization and implementation of key energy special projects, the overall responsibility for the implementation of the performance of special projects, can be based on the implementation of the need to establish cross-sectoral coordination mechanisms, by the National Energy Board of Energy Conservation and Science and Technology Equipment Division (hereinafter referred to as the Division of Science and Technology) specific undertakings, the main responsibilities include:

(a) Research and development of special management implementation rules and other regulations, the Ministry of Science and Technology, the Ministry of Finance consistency review issued after implementation;

(b) Propose professional organizations to undertake specific project management work, sign task entrustment agreements with professional organizations to undertake specific project management work for key projects, entrust and guide professional organizations to do specific management and implementation work for special projects, and supervise their performance of duties and responsibilities;

(c) Organizing the preparation of special implementation programmes, funding estimates and annual guidelines;

(d) Forming a special expert committee on the basis of experts in the preparation of the implementation plan, and selecting and setting up a special guideline expert group to support the organization, implementation and management of the special project;

(e) Carrying out compliance audits of annual project arrangement proposals (including budget arrangement proposals), issuing project approval to professional bodies in accordance with the audited opinions, and organizing professional bodies to complete project publicity and issue project notices;

(vi) Organize the preparation of an annual budget plan for management work;

(vii) Organizing and carrying out supervision and inspection of the implementation of special projects, and proposing adjustments to major matters based on the progress of implementation or inspection and evaluation;

(viii) Organize the preparation of special annual performance reports, interim performance reports and special summary reports, and be responsible for organizing professional institutions to carry out comprehensive performance evaluation of projects and submit applications for overall acceptance;

(ix) Organize professional institutions and relevant project undertakings to cooperate with the Ministry of Science and Technology and the Ministry of Finance in key node assessment, supervision and evaluation, and overall acceptance;

(j) In accordance with the relevant provisions on national confidentiality, improve the responsibility system for special confidentiality work and do a good job in the management of special confidential information;

(k) Promote the application and industrialization of special achievements, do a good job in the relevant industry or regional policies, planning, standards, etc., and the interface of special work, is responsible for the special results of the transformation of the assessment of the results of accountability.

Article X. Energy key special expert committee selected by the National Energy Administration, set up a special expert committee director, deputy director, in principle, the expert committee experts can not declare the special project (subject), the main responsibilities include:

(i) Conducting development strategy and policy research on relevant specialties;

(ii) Participating in the preparation of relevant special implementation programs and providing professional advice for the preparation of annual project declaration guidelines;

(iii) Advice in the compliance review of project establishment;

(d) Participating in the annual and mid-term management, supervision and inspection, project acceptance and performance evaluation of the relevant special projects, and advising on the optimization and adjustment of the relevant special projects.

Article 11: The expert group of the Key Energy Special Project Guide shall be selected and formed by the National Energy Administration, and the head and deputy head of the expert group shall, in principle, be the director and deputy director of the Special Expert Committee. In order to enhance the scientific and impartiality of the guide layout, the guide expert group experts need to replace some experts every year, in principle, the number of replacement experts for the previous year's expert group about 1/3 of the number of experts, and the year guide experts can not declare the relevant special projects (topics) in the current year. The main duties of the Guide Expert Group include:

(i) Conducting development strategy and policy research on relevant specialties;

(ii) Following the relevant special implementation program, it is responsible for the preparation of annual project declaration guidelines and proposes annual project declaration guidelines;

(c) Participating in the annual and mid-term management, supervision and inspection, project acceptance and performance evaluation of the relevant special projects, and advising on the optimization and adjustment of the relevant special projects.

Article 12 The professional organization, under the guidance of the National Energy Administration, shall carry out specific project management work in accordance with the relevant management regulations of the key special projects and the task entrustment agreement, and shall be responsible for the management of project tasks and funds. Responsible for the process management of the project, the main responsibilities include:

(i) Conducting strategic research in relevant fields, strengthening the tracking and evaluation of scientific and technological development in relevant fields, and continuously strengthening specialized capacity building;

(ii) Cooperate with the main unit to organize the preparation of special budget estimates, support the preparation of special annual project declaration guidelines;

(c) Responsible for the acceptance of project declarations, formal review and evaluation of projects, assisting the National Energy Administration in completing the project publicity, issuing notices of project establishment, and signing the project mission statement with the project leader under the organization of the National Energy Administration;

(d) Being responsible for management and service work such as project fund disbursement, annual and mid-term inspections, comprehensive performance evaluation, and dynamic adjustment of projects according to procedures;

(e) Strengthening the integration and coordination of projects under the special project and promoting the organization and implementation of the special project as a whole;

(vi) Reporting on the implementation of special projects and their programs and major matters as required, and accepting supervision;

(vii) Responsible for the follow-up management of the project after the comprehensive performance evaluation, archiving and preserving the relevant information of the project, and promoting the popularization, application and transfer of the project results;

(viii) Strengthening the guidance and supervision of various types of experts involved in project management activities, giving full play to the role of experts in accordance with the principles of openness, fairness, impartiality and avoidance of interests, and supporting specific project management work.

Article 13 The project undertaking unit (including the project lead undertaking unit and participating units) is the main body responsible for the implementation of the project, responsible for the specific organization and implementation of the project, and should strengthen the responsibility of the legal person. The main responsibilities are:

(a) Organize the implementation of the project in accordance with the signed project mission statement, fulfill the terms of the mission statement, implement supporting conditions, and complete the project research and development tasks and objectives;

(ii) Strictly implement the management regulations of the project, establish and improve internal management systems for scientific research, finance and integrity, strengthen internal control and risk management, and take responsibility for project implementation and fund management;

(iii) Timely preparation of project implementation reports, information statements, scientific and technical reports, etc., as required;

(iv) Reporting in a timely manner on major matters arising from the implementation of projects and submitting for approval, in accordance with procedures, matters requiring adjustment;

(v) Accept guidance, inspection and cooperation in monitoring, evaluation and acceptance;

(vi) Fulfilling the responsibilities and obligations of confidentiality and intellectual property protection, and promoting the transformation, application and industrialization of project results.

Article XIV of the local energy department in charge of science and technology, development and reform, finance, education, industry and information, market, intellectual property rights and other departments to do a good job in the key energy special projects in the region's task support, coordination, supervision and other work of the localities, and the implementation of supporting funds, R & D platforms, innovation and talent, the results of the transformation, the popularization and application of the relevant conditions, to accelerate the promotion of the application of innovation results in the economic and social development.

Chapter III. Project Declaration and Establishment

Article 15 The National Energy Administration shall, according to the major national strategies and relevant planning, set up an expert group for the guidelines of each special project, unite with relevant professional organizations, and widely solicit the demand for the guidelines in conjunction with the relevant departments, and prepare the annual guidelines of the special projects in a combination of the "top-down" and "bottom-up" approaches, in full compliance with the overall objectives and task settings set forth in the implementation plan of the special projects, avoiding cross-duplication. In a combination of "top-down" and "bottom-up" approaches, the annual guidelines for special projects will be compiled in accordance with the overall objectives and tasks set forth in the special implementation program, avoiding cross-repeat, and clarifying the direction of the tasks, requirements of the objectives, conditions for formal review and project selection methods.

After the annual guidelines for special projects are reviewed by the expert group on guidelines, checked by the National Science and Technology Management Information System (NSTMIS) and considered by the National Energy Administration (NEA), they will be openly solicited by the public, evaluated, and then uniformly released through the National Science and Technology Management Information System in accordance with the procedures. Guidelines involving confidential or sensitive information are issued in accordance with relevant confidentiality management regulations.

Article XVI of the key energy special comprehensive use of open competition, directional selection, directional commissioning and other project selection methods, preferential determination of the project's scientific research team.

(a) Projects that take an open and competitive approach to selecting R&D teams are organized in accordance with the procedures of public release of guidelines, free declaration, unit recommendation, expert evaluation, merit-based support, public announcement of results, and approval of project establishment;

(b) Projects that adopt a targeted and merit-based approach to selecting R&D teams are organized in accordance with procedures such as determining the scope of invitation, issuing guidelines in a targeted manner, making declarations in response to invitations, nominating units, evaluating by experts, providing support on the basis of merit, and approving the establishment of projects;

(c) Projects that adopt a targeted commissioning approach to select R&D teams are organized in accordance with the procedures of identifying candidate units, issuing guidelines in a targeted manner, making declarations upon invitation, nominating units, validating and reviewing arguments, and approving the establishment of projects.

Article XVII of the key energy projects to explore the implementation of the classification of the "list of commanders", "horse race", "chain master system" and other new types of project organization model.

(a) For projects with urgent needs and arduous objectives and tasks, the mode of organizing and implementing the project can be explored by adopting the mode of "revealing the list of commanders". Project declaration "does not set a threshold", the lead declaration and participating units without registration time requirements, the project (subject) responsible person without age, education and title requirements.

(ii) For projects that are urgent, have multiple potential technology routes or require different application scenarios to verify their effectiveness, a "race to the top" model can be explored. The projects will be organized in parallel, with multiple project leaders working on the same project.

(c) For projects that strengthen the in-depth integration of industry, academia and research and enhance the modernization level of the industrial chain, the mode of "chain master system" can be explored for organization and implementation. The lead declaring unit should take the main enterprise of the industrial chain as the core, and form an innovation consortium with the backbone enterprises in the industrial chain to jointly carry out the key core technology research and development.

Article 18 The project undertaking unit shall in principle be an independent legal entity registered in mainland China for one year, with strong scientific research capability and conditions and good integrity; the project (subject) leader shall in principle not be more than 60 years old, and shall meet the requirements of the Notice of the Office of the Ministry of Science and Technology and the Ministry of Finance on Further Strengthening the Management of Coordinated National Science and Technology Program Project Establishment (Guoshi). Article 19 The project declaration generally adopts one-time declaration, and the lead undertaking unit of the project shall submit the project declaration materials at one time through the national science and technology management information system in accordance with the requirements of the project declaration guidelines before the deadline of declaration acceptance.

For open competition guidelines, project leaders should submit a pre-declaration, a formal declaration and a budget declaration in one go. For targeted merit-based guidelines, project leaders should submit the official declaration and budget declaration in one go. For the guidelines of targeted entrustment category, the project leader shall directly submit the project mission statement (including the project budget). In principle, it takes no less than 50 days from the date of publication of the guidelines to the deadline for acceptance of project declarations.

Article 20 Professional organizations shall accept project applications through the national science and technology management information system, carry out formal review according to the requirements of the guidelines, and strengthen the review of scientific research integrity. For targeted commissioning guidelines, professional institutions do not need to carry out formal review, but can directly organize evaluation experts to review the mission statement submitted by the project lead unit.

After submitting the results of project acceptance and formal review to the Department of Science and Technology of the National Energy Administration, the professional organization shall carry out the first round of evaluation and defense evaluation for the project teams that have passed the formal review. For the open competition guidelines, after the project declaration and formal review, the professional organization shall sort out the declaration situation, and for the guideline direction that the number of declared teams is not more than the number of projects to be supported after the formal review, such as the non-"Young Scientist" guideline, it shall not start the subsequent project evaluation and establishment procedure, and shall submit the relevant guideline direction and the corresponding project declaration to the Science and Technology Department of NEA. The relevant guideline direction and corresponding project declaration will be submitted to the Science and Technology Department of the National Energy Administration; the "Young Scientist" guideline can normally start the subsequent project evaluation and establishment procedure.

Article 21 The professional organization shall study and formulate the first round of evaluation plan, and organize and carry out the evaluation work after the examination and approval of the Science and Technology Department of the National Energy Administration. The first round of evaluation can take the form of network evaluation, communication evaluation or conference evaluation, etc., and organize evaluation experts to carry out evaluation according to the pre-declaration submitted by the project declaration team, without requiring the project declaration team to defend, and select 3 to 4 times the number of declared projects to be set up through the first round of evaluation on the basis of merit.

If the project declaration team is less than 3 to 4 times of the proposed number of projects, or involves no more than 3 to 5 items of the annual guidelines, the professional body may, depending on the situation, not organize the first round of evaluation, and directly carry out the defense evaluation.

Article 22 The professional body shall study and develop the project defense review program, after review by the Science and Technology Department of the National Energy Administration, according to the guide to determine the project selection method using the network review, communication review, conference review, the same field, on-site inspection and evaluation of assessment and other ways of organizing the review.

Before organizing the defense and evaluation, the professional body shall request the evaluation experts to review the evaluation materials in advance, and explain to the evaluation experts on the content of the guidelines, evaluation rules, etc., and simultaneously notify the implementation of the projects that have been terminated due to the responsibility of the undertaking unit or have failed in the comprehensive performance evaluation in the key energy special projects.

Article 23 The project evaluation experts shall be high-level experts with rich experience and objectivity and impartiality in the field of energy, and in principle, they shall be selected from the national scientific and technological expert database, and the avoidance system shall be implemented. Project evaluation experts shall be strictly managed and utilized by means of honest review beforehand, reminder supervision in the middle of the process, and spot-check evaluation afterward.

Article 24 According to the results of the evaluation of professional institutions, the formation of annual project arrangement proposal (including budget arrangement proposal), the National Energy Board for compliance audit, after the audit, the National Energy Board issued project approval, the organization of professional institutions in accordance with the procedures of the project with the project undertaking units signed the project task statement. If the project has a subject, the project leader shall sign the task statement with the subject undertaking unit.

For projects involving state secrets, the professional body should organize the project lead undertaking unit to sign a confidentiality agreement and guide it to do a good job of confidentiality management.

After the project is established, the professional body shall allocate funds to the project undertaking unit in a timely manner in accordance with the agreement of the mission statement, the progress of project implementation and the completion of tasks.

Article 25 The mission statement of the project (subject) shall be based on the project declaration, declaration and defense report materials and expert evaluation opinions, highlight performance management, clarify the assessment objectives, assessment indicators, assessment methods and methods, and mark the core indicators of the project. The assessment indicators of the project shall not be lower than the assessment indicators of the guidelines and the indicators proposed in the declaration, and the assessment indicators of the guidelines shall in principle be labeled as the core indicators of the project.

Article 26 The professional organization shall give timely feedback to the project lead undertaking unit through the national science and technology management information system on the results of the formal review and evaluation, and establish a mechanism for handling project complaints, accept project-related complaints and suggestions in accordance with the regulations, carry out complaint investigations, and report the relevant situation to the National Energy Administration (NEA), and then give timely feedback to the complainant on the handling opinions after the examination and approval of the National Energy Administration (NEA).

Chapter IV. Project process management

Article 27 The project undertaking units shall implement "milestone" management according to the overall objectives and task division arrangement determined in the project (subject) mission statement, fulfill their respective responsibilities and obligations in accordance with the requirements of integrated organization and implementation, do a good job in communication, interaction, articulation and integration among different tasks, and complete the relevant R&D tasks and objectives according to the schedule and with high quality. and objectives, and promote the transformation and industrialization of project results. If the project implementation involves works that really need to be included in the planning by the relevant government authorities, the project undertaking unit shall fulfill the relevant declaration and review procedures in a timely manner according to the relevant regulations.

Article 28 The project lead undertaking unit and the project leader shall effectively carry out the lead responsibility, organize the development of a work plan for the integrated organization and implementation of the project, specify the specific ways of regular scheduling, node control and synergistic advancement, and strictly implement them in the project implementation, comprehensively grasp the progress of the project and provide support for the smooth advancement of the various research tasks. Major matters and significant problems that may affect the implementation of the project shall be reported to the professional organizations and countermeasures and recommendations shall be studied in a timely manner.

Article 29 The subject undertaking unit and participating units shall actively cooperate with the supervision, coordination and scheduling work organized by the project lead undertaking unit, participate in centralized exchanges, thematic seminars, information sharing and other communication arrangements as required, report on the progress of the research and major issues in a timely manner, and support the project lead undertaking unit to strengthen the integration of research results.

Article 30 In the implementation of the project, the professional institution shall arrange special persons to be responsible for project management, services and coordination and guarantee work, organize annual reports, key node assessment and random sampling in due course, and comprehensively understand the progress of the project and its organization and implementation by means of follow-up, centralized reporting and thematic research, etc., study and deal with the relevant major matters and issues raised by the project lead unit in a timely manner, and timely judge the project implementation situation, the performance capability of the undertaking unit and personnel, etc. It will study and deal with major matters and issues raised by the project lead unit in a timely manner, and make timely judgment on the implementation of the project and the performance ability of the undertaking unit and personnel. At key points in the implementation of the project, timely comments and suggestions are made to the project leader.

Article 31 For relevant projects with upstream and downstream relationships in the innovation chain or with strong correlation, the professional organization shall establish a special coordinating and management mechanism, supervise the lead undertaking unit of the relevant projects to strengthen coordination and linkage in the implementation of the projects, and complete the research and development tasks together in accordance with the deployment and schedule of the special implementation plan.

Article 32 The professional body organizes the project lead undertaking unit to report the annual implementation report of the project (including budget implementation) through the national science and technology management information system before the end of November each year, and the project implementation of less than three months can be reported together in the next year. Before December 15 each year, the professional organization to form a special annual implementation report, after review by the National Energy Administration, by the National Energy Administration to the Ministry of Science and Technology.

Article 33 The implementation period of more than five years of key energy special projects, professional institutions should be in the special implementation of the mid-year organization to compile and report on the implementation of the special mid-term report and submitted to the National Energy Administration for review and approval, submitted to the Ministry of Science and Technology.

Article 34 For projects with an implementation cycle of three years or more, in the middle of the project implementation, the professional organization shall carry out an interim inspection of the project implementation in accordance with the project mission statement, so as to fully grasp the progress of the project. Professional organizations should formulate the mid-term inspection work plan in the first quarter of each year, and report it to the Science and Technology Department of the National Energy Administration for the record to carry out the inspection work.

Through the mid-term inspection, the professional organization shall study and handle the relevant major matters and issues raised by the project undertaking unit, and review and approve the relevant adjustments in accordance with the procedures, make a judgment on whether the project can complete the predetermined tasks and objectives, and form a report on the mid-term implementation status, which shall be reported to the National Energy Administration for record. For projects with clear application demonstration objectives, the professional organization shall invite the Science and Technology Department of the National Energy Administration and relevant departments and localities to jointly carry out mid-term inspection.

Article 35 For two projects that are supported simultaneously in the process of establishing projects with "the same guideline direction and different technical routes" or projects that are organized and implemented in the mode of "racing for the first place", the professional institution shall, according to the time nodes agreed in the project task book, formulate an evaluation and merit selection work plan based on the project task book and submit it to the National Energy Administration for record, and then carry out the evaluation and merit selection work on the implementation of the two projects. The professional organization shall, according to the time node agreed in the project mission statement, formulate a work plan for assessing and selecting the best projects, and report it to the National Energy Administration for the record, and then carry out the assessment and selection of the best projects. Based on the evaluation results, the professional organization shall make recommendations on whether to continue to support the project, and form a report on the evaluation and selection of the project, which shall be submitted to the Science and Technology Department of the National Energy Administration for review and approval by the professional organization. For projects "recommended for continued support", the project leader shall continue to implement the project according to the requirements agreed in the original mission statement; for projects "not recommended for continued support", the project shall be dealt with according to the termination procedure.

Article 36 The professional bodies may, in conjunction with the Science and Technology Department of the National Energy Board and the relevant departments, organize relevant experts on special projects with significant implementation risks, around the project progress, use of funds and other aspects of assessment and supervision, and according to the assessment and supervision of the views of the organization of the project lead bearer to carry out corrective actions, and the failure to rectify the effectiveness of the project can be proposed termination recommendations, in accordance with the procedures for submission to the National Energy Board for review.

Article 37 During the implementation of the key energy special projects, involving special objectives, progress, organization and implementation of major adjustments, by the National Energy Board in accordance with the implementation of the progress or inspection and evaluation of the situation put forward proposals, reported to the Ministry of Science and Technology, the Ministry of Finance for review and approval in accordance with the procedures.

Article 38 If necessary adjustments are to be made to related matters during the implementation of the project, they shall be reported for approval or filing in accordance with the following procedures:

(a) Changes in the project lead unit, project leader, project implementation cycle, the project's main research objectives and project assessment indicators and other major adjustments, by the professional body to directly put forward the views of the project lead unit, or the project lead unit put forward a written application, the professional body of the special committee of experts to study the specific processing views, reported to the National Energy Board of Science and Technology Division for review and approval by the professional body.

(ii) change the subject unit, the subject unit, the subject person in charge, the subject implementation cycle, demonstration site, the subject of the main research objectives and subject assessment indicators and other important adjustments, by the project lead unit to apply to the professional body, the professional body to put forward a specific opinion and approval, to the National Energy Board of Science and Technology Division for the record.

(c) Other general adjustment matters, such as changing the key personnel for research and development of the subject and general participants, are handled by the project lead undertaking unit, and timely filed with the professional organization. The professional organization and the overall expert group shall provide good guidance.

In principle, the core indicators of the project will not be adjusted. The project leader and project leader shall not be adjusted unless necessary. If the project leader or subject leader really needs to be adjusted, before the end of the project implementation period, the former project leader or subject leader shall not participate in the declaration of other key special projects of the National Key Research and Development Program or national scientific and technological major special projects as the project (subject) leader. Within 6 months before the end of the project implementation period, the project leader shall not apply for major or important adjustments.

Article 39 If the project implementation encounters one of the following situations, the signatories of the project mission statement can put forward the proposal of withdrawing or terminating the project, and the professional organization shall consult with the special expert committee to put forward opinions on the proposal of withdrawing or terminating the project, and report to the National Energy Administration for examination and approval of the implementation.

(i) The technical route of the project has been proved to be unreasonable and infeasible, or the project is unable to realize the progress stipulated in the mission statement and there is no way to improve it;

(ii) Funds, raw materials, personnel, support conditions, etc., required for the completion of project tasks have not been realized, or have changed so that the research cannot be carried out normally;

(iii) Ineffective organizational management or major problems that prevent the project from proceeding;

(iv) Serious intellectual property disputes in project implementation;

(v) Failure or refusal to make corrections as required in the implementation of the project;

(vi) Serious violations of discipline and law and serious scientific misconduct in the implementation of the project;

(vii) Other cases where the project's mission statement stipulates that it may be withdrawn or terminated.

Article 40 Upon approval of the withdrawal or termination of the project, the project leader shall make a written report on the work carried out, the use of funds, the purchased equipment and instruments, milestones, intellectual property rights, etc., and after verification and approval by the professional organization, complete the audit of the fund expenditure and surrender of funds in accordance with the rules and regulations and other follow-up work. For the withdrawal or termination of the project due to non-legitimate reasons, the professional organization should identify the specific reasons, clarify the responsible person and responsible unit, form a special report to the National Energy Administration for review, the National Energy Administration after verification of the seriousness of the treatment and accountability at each level of the scientific research of the breach of trust and failure to return to the behavior of scientific research into the integrity of the record.

Article 41 The scientific and technological report system shall be implemented, and the collection of scientific and technological reports shall be incorporated into the project management process. The scientific and technological reports on key energy projects mainly include one or more research reports on the research direction of the project, as well as various types of experimental reports, analytical test reports, engineering test reports, research reports and other reports containing details of the scientific research activities and basic scientific research data generated in the course of implementation.

Article 42 Implement the provisions of archive management, and incorporate the archive management work into the overall work of the key energy special projects. Key energy special files refers to the key special planning, demonstration, organization and implementation, supervision and assessment, comprehensive performance evaluation and other processes, with preservation value of text, charts, audio and video and other forms of historical records.

Chapter V. Comprehensive performance evaluation

Article 43 Upon the expiry of the project implementation period, the professional body shall immediately organize and launch a comprehensive performance evaluation. The comprehensive performance evaluation of the project is categorized according to the project mission statement and relevant requirements, and a one-time comprehensive performance evaluation is carried out. The evaluation focuses on the completion of project (subject) tasks and the management and use of funds, and shall be goal-oriented and result-oriented, focusing on the core objectives and representative results.

Article 44 If the project cannot be completed on schedule for any reason and has to apply for an extension, the project leader shall apply for an extension six months before the end of the project implementation period, and the professional organization shall consult with the special expert committee to put forward specific opinions on the process, which shall be reported to the National Energy Administration for review and approval by the professional organization. In principle, the project extension can only be applied for once, and the extension time shall not exceed one year.

Article 45 The project undertaking unit shall take the main responsibility for the management of the scientific research achievements of the unit, and shall be responsible for organizing the review of the authenticity of the achievements of the scientific researchers of the unit, and reviewing the completeness, accuracy and systematicity of the scientific research files in accordance with the principle of classification and hierarchical management; the lead project undertaking unit and the project leader, and the project undertaking unit and the subject matter leader, shall be responsible for reviewing and checking the achievements related to the project or the subject matter. The project lead undertaking unit and the project leader, the subject undertaking unit and the subject leader are responsible for reviewing and checking the completion of the scientific and technological reports and the filling of scientific and technological achievements, and shall not include the achievements outside the project undertaking unit, or the achievements outside the project tasks, in the comprehensive performance evaluation materials.

Article 46 The comprehensive performance evaluation of a project shall be divided into two stages, namely, subject performance evaluation and comprehensive project performance evaluation, and the comprehensive project performance evaluation shall be carried out on the basis of the completion of subject performance evaluation. If there is no topic or only one topic under the project, the performance evaluation of the topic may not be organized.

Article 47 The project leader is responsible for organizing the performance evaluation of the project and is responsible for the conclusions of the performance evaluation; the professional body is responsible for organizing the comprehensive performance evaluation of the project. The general requirements are as follows:

(a) In the comprehensive performance evaluation exercise, the completion of comprehensive project tasks and the use of funds are considered in an integrated manner, with the main assessment of the completion of project objectives and assessment indicators, the effectiveness of results, the cultivation of human resources, organizational management, and the management and use of funds.

(ii) Highlighting the evaluation of representative achievements and the effect of project implementation, and not taking "talent project", "title", "hat", "number of papers", "award", etc. as evaluation indexes. "(b) The evaluation of representative achievements and the effect of project implementation shall be emphasized. Basic research and applied basic research projects focus on evaluating the significant originality and scientific value of new discoveries, new principles, new methods and new laws, the effectiveness of solving key scientific problems in economic and social development and national security needs, the effect of supporting technology and product development, the quality and level of scientific research results, such as representative papers, with international and domestic peer review as the main focus. Technology and product development projects focus on evaluating the innovativeness, maturity, stability and reliability of new technologies, new methods, new products and key components, highlighting the transformation and application of the results and their role in solving the key problems of economic and social development and supporting and leading the development of industries. The performance evaluation of application demonstration projects is oriented to large-scale application and promotion within the industry, focusing on the evaluation of integration, advancement, economic applicability, radiation-driven role and economic and social benefits, and more application and promotion of related party evaluation and market evaluation. For projects with clear technical routes and clear quantitative assessment indicators, the Technology Readiness Level (TRL) evaluation method can be explored in the comprehensive performance evaluation.

(c) For key core technology research projects, the important roles of demand-side, users, industry and other parties should be further utilized, and representatives of demand-side, users and industry should participate in the comprehensive performance evaluation work, fully express their opinions, and take the evaluation opinions of demand-side and users on the completion of the project, as well as their opinions on the popularization and application of the project results, as the core opinions of the evaluation.

(d) Professional organizations should deploy the comprehensive performance evaluation work in advance, notify the project lead unit to make preparations, and at the same time, formulate the annual comprehensive performance evaluation work plan of the key special projects, and report it to the Science and Technology Department of the National Energy Administration for the record.

Article 48 The subjects under the project shall be evaluated before the expiry of the project implementation period by the project lead undertaking unit to organize the performance evaluation of the completion of the subject tasks, and the subject undertaking unit and the person-in-charge shall carefully prepare a self-evaluation report on the subject performance. At the same time, the project undertaking unit shall select a qualified accounting firm to carry out the project closing audit. The conclusion of the subject performance evaluation is divided into two categories: passed and failed.

Article 49 The project lead undertaking unit and the project leader shall complete the preparation of the comprehensive performance evaluation materials of the project within 2 months after the end of the project implementation period, and submit the relevant evaluation materials through the national science and technology management information system according to the relevant requirements of the professional organization. The professional organization shall complete the comprehensive performance evaluation of the project within 3 months after receiving the comprehensive performance evaluation materials, and report the comprehensive performance evaluation opinions of the project to the National Energy Administration.

Article 50 Professional institutions shall, in accordance with the requirements for performance classification and evaluation of scientific research projects, organize an expert group on integrated performance evaluation of projects according to different project types, and adopt peer review, third-party assessment and testing, user evaluation and other methods to carry out integrated performance evaluation, with on-site verification if necessary. For related projects with upstream and downstream relationships in the innovation chain or with strong correlation, there should be an overall design in the performance evaluation to strengthen the assessment of the integrated implementation performance.

(a) In order to facilitate the relevant departments to grasp the effectiveness of the implementation of key special projects, and to promote the transformation and application of subsequent results, the comprehensive performance evaluation of the project should generally invite the Science and Technology Department of the National Energy Administration and the relevant divisions and departments and localities to participate.

(ii) The expert group on comprehensive performance evaluation of projects implements the recusal system and integrity commitment. The expert group consists of technical experts and financial experts, etc., with the head of the group being a technical expert and the deputy head of the group being a financial expert, and the total number of experts is generally no less than 10 (with no less than three financial experts).

(c) When carrying out a comprehensive performance evaluation of the project, the expert group will review and comment on the basis of reviewing the information, listening to the report and questioning, etc., and taking into account the information on the annual and mid-term implementation of the project.

Article 51: The comprehensive performance evaluation of a project shall be based on the deliberations of the expert group, with the experts filling in the individual expert evaluation opinion form, and the expert group issuing a comprehensive performance evaluation of the project after deliberation. The conclusion of the comprehensive performance evaluation of the project is divided into two categories: passed and failed. For projects that pass the comprehensive performance evaluation, the performance level is divided into two grades: excellent and qualified.

(i) The completion of the objectives and tasks defined in the project mission statement on time and with quality is a pass.

(ii) Failure to accomplish the main objectives and tasks defined in the project mission statement is considered a failure.

(c) If a scientific and technical report is not submitted as agreed in the mission statement or if the materials are not submitted on schedule, if the documents, information and data provided are false, if major adjustments are not reported and approved in accordance with the relevant requirements, if there is a serious breach of trust on the part of the project lead undertaking unit, the subject undertaking unit, the participating units or individuals that has a significant impact, and if the project lead undertaking unit, subject undertaking unit, participating units or individuals refuse to cooperate with the work of the comprehensive performance evaluation or do not carry out the performance evaluation of the subject after the due date, they will all be treated as failing to pass. The project will be processed as not passed.

(d) For projects that have passed the comprehensive performance evaluation, the professional organization shall, based on the comprehensive performance evaluation and after consulting with the special committee, study and give a recommendation for projects with excellent performance rating, and report to the National Energy Administration for examination and determination.

Article 52 The professional organization shall form a comprehensive performance evaluation opinion on the project based on the comprehensive performance evaluation of the project. Within three months after receiving the comprehensive performance evaluation materials of the project, the professional organization shall, after completing the comprehensive performance evaluation of the project, submit the comprehensive performance evaluation opinions of the project to the National Energy Administration. The National Energy Administration shall complete the review of the comprehensive performance evaluation of the project and issue the evaluation conclusion to the project lead undertaking unit.

Article 53 For the projects that fail in the comprehensive performance evaluation, the professional organization shall, together with the project performance evaluation experts and the key special expert committee, carefully analyze the reasons for the failure of the project and submit a special report to the National Energy Administration (NEA). For units, teams and individuals that fail to perform well, NEA will deal with them in accordance with relevant regulations, and the results shall be announced to the society in an appropriate manner and incorporated into the scientific research integrity records in accordance with the procedures.

Article 54 The professional organization shall urge the project lead undertaking unit to file and manage the project's comprehensive performance evaluation materials and relevant technical documents within three months after receiving the conclusion of the comprehensive performance evaluation of the project. Matters involving scientific and technical reports, data remittance, technical standards, results management and archive management shall be implemented in accordance with the relevant management regulations. The professional organization will summarize the written materials and electronic version on a quarterly basis and submit them to the Science and Technology Department of the National Energy Administration for record.

Article 55 The National Energy Administration shall organize professional institutions, special expert committees and project leading units to complete the summary assessment within 6 months after the execution period of the key energy special projects, submit the summary report and overall acceptance application to the Ministry of Science and Technology, and cooperate with the Ministry of Science and Technology and the Ministry of Finance to carry out the overall acceptance of the special projects.

Chapter VI. Management of funds

Article 56 of the key energy special adheres to the principle of diversified financing, strengthen the central linkage, government and enterprises, to guide the local, enterprises, financial capital and other social funds, such as joint investment, to support the relevant departments and institutions to strengthen the undertaking of related projects of science and technology enterprises throughout the life cycle, the whole chain of scientific and technological financial services.

Article 57 The arrangement and use of the central financial funds for key energy special projects shall strictly implement the relevant provisions of the State budget management and financial treasury management, and shall support specific projects in a categorized manner through pre-subsidies, post-subsidies and milestone allocations. Among them, those involving government procurement should also implement the provisions of the government procurement legal system. Specialized full implementation of budget performance management, special account management, earmarking, the establishment of a fund supervision mechanism covering the entire process of fund management and use, and the improvement of the efficiency of fund use.

Article 58: For projects implementing new organizational and implementation mechanisms such as the "List of Commanders", "Horse Race for First Place" and the "Chain Master System", according to the characteristics of the project, a lump-sum system, negative list and other methods may be explored. A variety of ways.

Article 59 The management of funds follows the principle of "clarifying rights and responsibilities, and equalizing rights and responsibilities", and gives full autonomy to project undertaking units and researchers. Project units and researchers shall be responsible for the compliance and effectiveness of the use of project funds. The management and utilization of funds shall be included in the comprehensive performance evaluation of the project.

Chapter VII Monitoring and evaluation

Article 60: The supervision and evaluation of key energy special projects will be unified into the supervision and evaluation system of the National Key Research and Development Program. The supervision and evaluation of the special projects shall be based on the special implementation plan, relevant systems and regulations, project declaration guidelines, project approval, mission statement and agreement, etc., and shall be organized in accordance with the principle of consistency of responsibility and authority.

Article 61 The National Energy Administration shall actively cooperate with the Ministry of Science and Technology, the Ministry of Finance to carry out key nodes of the assessment and evaluation and sampling verification, through the daily supervision of the progress of the implementation of the special projects and milestone results outputs, and urge the special high-quality implementation.

The National Energy Administration (NEA) supervises and evaluates the implementation process and progress of each key energy special project, and supervises the management of the entrusted professional organizations.

Professional organizations carry out daily supervision of project implementation and project undertakings, and may carry out relevant work through annual reports, mid-term inspections, assessment of excellence, etc., report information on major emergencies occurring in the course of project management to the Science and Technology Division of the National Energy Administration in a timely manner, and cooperate with the Science and Technology Division of the National Energy Administration to do a good job in tracking and implementing the relevant processing opinions and supervising rectification.

The project undertaking unit shall effectively implement the responsibility of the legal person, carry out daily supervision and management of the implementation of the tasks of the project undertaken, the use of funds and the situation of the participating units, and strengthen internal oversight.

Article 62 The National Energy Administration and professional organizations to carry out supervision and assessment of key energy special projects shall generally formulate an annual work plan, specify the scope, focus, time and mode of supervision and assessment for the year, avoid cross-repeat and focus on playing the role of the special expert committees. Where the supervision and assessment of projects is concerned, it shall mainly focus on key projects relating to the overall implementation effect of the relevant key special projects.

Article 63 The National Energy Administration shall use information technology to carry out supervision and evaluation of key energy special projects, go into the front line of scientific research and management, and strengthen the supervision of the matter in the midst of the incident, after the incident and the key links, but it shall not interfere with the normal project management and reduce the burden of scientific researchers. The main contents of supervision include, but are not limited to, the following aspects:

(i) The scientific and standardized nature of the management of the professional body, and its due diligence and performance in the process of project management;

(ii) Implementation of the system of responsibility of the legal person of the project undertaking unit, implementation of the project and management and utilization of funds;

(c) Experts involved in the consulting, evaluation and supervision of science and technology programs and projects, as well as the performance of duties and responsibilities by support institutions;

(d) Scientific integrity and fulfillment of duties and responsibilities of scientific researchers in project declaration, implementation and fund management and use;

(v) The realization of project task objectives, output of landmark results, completion of assessment objectives, transformation and application of results and user evaluation;

(vi) The effectiveness of supervision measures, the timeliness of identifying and dealing with project implementation risks, and the remittance of supervision and management data.

Article 64 The National Energy Administration shall, in conjunction with professional organizations, establish a working mechanism for public participation in supervision, take the initiative in accepting supervision by the public and public opinion, strengthen the synergy with external supervision such as audit supervision and third-party supervision, ensure that the management is standardized, and implement a system for the supervision of scientific and technological ethics.

Article 65 When project implementation risks are found, major clues of irregularities and disciplinary violations are received, or major controversial events in project management occur, the National Energy Administration shall carry out investigations and verifications, or instruct professional organizations to investigate and verify, and put forward opinions and recommendations.

Article 66 Supervision shall result in supervisory conclusions and opinions. Where further improvement is needed to perfect project management or organizational implementation, clear recommendations or requirements shall be made, and the professional body shall be instructed to verify the specific situation in a timely manner and take corresponding measures to rectify the situation.

Article 67 establishes an incentive mechanism for innovation, based on the results of supervision and evaluation of the organization and implementation of key special projects in the field of energy to make important contributions to the unit, team and individuals, in accordance with relevant state regulations to be commended and rewarded as a key special projects to follow up on the layout of the adjustment, the task of undertaking, resource allocation and rolling support for the project, the direction of the entrusted selection and other important references.

Article 68 deals with violations in a timely and serious manner, and implements accountability and responsibility reversal at each level. The consulting and evaluation experts with irregularities shall be warned, ordered to make corrections within a certain period of time, notified and criticized, and the qualifications of consulting and evaluation and declaration of participation in the project shall be canceled in a phased manner or permanently, etc.; for the project undertaking units and scientific researchers with irregularities, they shall be interviewed, notified and criticized, the allocation of funds for the project shall be suspended, the funds for the project shall be recovered, the project shall be withdrawn or terminated, and the qualifications of declaration of participation in the project shall be canceled in a phased manner or permanently, etc. For professional organizations that have violated the regulations, they shall be interviewed, criticized, terminated the entrustment agreement, and disqualified from project management in stages or permanently.

For scientific research violations and breaches of trust, the results shall be announced to the public in an appropriate manner, and shall be included in the database of serious violations of scientific research integrity as appropriate, and shall be dealt with seriously in accordance with the law. Those suspected of violating the law and discipline shall be transferred to the relevant departments.

Article 69 Relying on the national scientific and technological supervision information platform, the supervision and evaluation of the whole process of trace management. All kinds of supervision and inspection data generated by the National Energy Administration and professional organizations in the course of their work (such as annual and mid-term management, dynamic adjustment, supervision and evaluation of special projects, as well as information on the establishment of projects, funding arrangements, process management, acceptance and tracking and management of the transformation of the results of the projects) shall be brought into the platform in a timely manner, and the whole process of supervision and evaluation shall be traced, shared and utilized, and can be queried, appealed against and tracked, so that it can provide support for the special projects and their project management and supervision and evaluation.

Chapter VIII. Management of scientific and technological achievements

Article 70 Scientific and technological achievements refer to the achievements of academic value and use value obtained by utilizing the funds, equipment and other material and technological conditions provided by the project and the undertaking unit in the implementation of key special projects, including but not limited to technological methods, technological equipment, research and development platforms, research reports, demonstration projects and other scientific and technological achievements.

Article 71: The key energy special projects shall establish standardized and sound archives of scientific data and scientific and technological reports, and establish a system of summarizing, exchanging and sharing experimental materials and data. The project undertaking unit shall organize, file and archive the relevant materials in accordance with the relevant regulations to ensure that the files are complete, accurate and systematic, and that the scientific and technological achievements are completed in a timely, accurate and complete manner for reporting.

Article 72 The scientific and technological achievements are protected in the form of intellectual property rights such as patents, copyrights, softwritings and trademarks. Proprietary technologies and technical secrets shall also be included in the scope of intellectual property management of key specialties.

The scientific and technological achievements formed by the key special projects shall be labeled with the words "funded by the National Key R&D Program" and the project number on the type of intellectual property rights that can be labeled with information, and the English label shall read: "National Key R&D Program of China The English label: "National Key R&D Program of China". The first labeled results shall be used as the basis for acceptance or assessment. In case of patent application, the information declaration of the funded project shall be made in accordance with the relevant requirements of the Implementation Plan for the Establishment of a Patent Declaration System for Financially Funded Scientific Research Projects.

Article 73 The project undertaking units shall establish and improve the intellectual property management system and strengthen the protection and utilization of intellectual property rights of scientific and technological achievements.

(i) Strengthening the sharing of intellectual property rights. Establish a mechanism for the transformation and utilization of intellectual property rights between projects in line with market rules and ownership protection, prioritize the use of such rights within key energy special projects, and promote technology sharing, information interoperability and benefit sharing. Where national security, national interests and major social and public interests are involved, the State may implement the intellectual property rights without compensation, or license others to implement the intellectual property rights with or without compensation.

(ii) Proper attribution of intellectual property rights and distribution of rights and interests. Project undertakings should agree on the principle of distribution of intellectual property rights and interests, and encourage project undertakings to establish an intellectual property rights and interests sharing mechanism with relevant enterprises, so as to promote the transformation and utilization of intellectual property rights and shorten the transformation and application cycle.

(c) Accelerating the transformation of intellectual property results. Before publishing papers, monographs, publicity reports, exhibitions and other activities involving confidential technical results, they shall be reviewed and filed by the National Energy Administration.

Article 75 During the implementation of the key energy special projects, the project undertaking units shall use the intellectual property rights and other intangible assets formed by the central financial funds, and manage them in accordance with the relevant provisions of the state.

Article 76 Compliance with relevant international conventions on intellectual property rights, the effective use of foreign intellectual property achievements, to avoid disputes over intellectual property infringement. It supports and encourages research results with important scientific and economic value to apply for foreign intellectual property protection, and enhances the international competitiveness of technologies and products with independent intellectual property rights.

Chapter IX. Bylaws

Article 78 The specialized institutions shall formulate specific work programs in accordance with these Rules and submit them to the National Energy Administration for examination and approval.

Article 79 These Measures shall be interpreted by the National Energy Administration and shall come into force on the date of their issuance.
